Why are Union meetings being changed to Sundays? I don't want to drive in
to Rochester on a Sunday!! Especially with gas prices so high! Keep it the way
it is!

 

This by-law change was introduced as a cost saving measure. We were holding three shift meetings on a Tuesday and paying Union officers (as is required) to perform the duties outlined in our UAW constitution. We also have an influx of younger members with small children and they had to get right home to get a child or children off the school bus or out of daycare. Those members now have the ability to attend a membership meeting on Sunday, and all officers are still required to attend at no charge to the membership.
 
The pros and cons were debated at our regular monthly membership meeting and then the membership voted in favor of this change. The by-law was called off at three consecutive membership meetings as is required before being debated and voted on. That is our democratic process.
 
We hope that our members from the outlying towns and areas will consider car pooling to cut the fuel expense. These meetings work best when well attended.

How is Delphi going to change to meet the new automobile industry shift to
smaller cars? what's going to happen with Gen 4?
 

Chairman Mike Rath and President Dan Maloney have been pressing for a more balanced product portfolio (eg. four cylinder fuel systems) long before the gasoline prices spiked. We have been pushing through all channels Union, management, and Government to bring new products including small engine and fuel cell products into our facility. We will never stop fighting to gain a secure future for our membership. 
Our membership has earned the right to not only survive but prosper! We produce the some of the most complex and technically challenging components in the powertrain system. We have demonstrated the ability to deliver the quantity and quality of "world class"products our customers demand. It makes good business sense and common sense to put new work into a proven winner, Rochester, we've earned it.

We are moving Union meetings to the third Sunday of every month at 10 AM as per the by-law change that the membership and international Union approved. The next meeting will be Sunday September 21st, 2008 at 10 AM. held at our local Union hall 221 Dewey Ave. Rochester, N.Y.

 What is the curent state of orders to Delphi, and are they going to increase in
the near future
 

Orders are down across the North American market for new automobiles, trucks, and SUV's. The high price of gasoline is the current most pressing reason that vehicle sales are down. The loss jobs and income due to bad trade agreements is the underlying incessant reason for the slump.
We don't foresee an increase in orders with our existing product line this year or next. We are pushing to gain new products and technologies to secure jobs for our local membership.

I am a skilled tradesman who was put on indefinate lay off in October of 2007. 
I have received my separation papers offering %1500 per month of service.  I
received an 8 hour paycheck for utilization in November.  That indicated to me
that I was still considered an employee of Delphi.  My life was put on hold for
the last 9 months with the idea that I would return to work.  When I called
benefits, I was told that I would only be paid for the months that I actually
worked.  It just doesn't seem right. I was an employee on indefinate layoff. I
am still an employee.  I would get utililzation pay even today. I am ready,
willing  and able to return to work at anytime (as stated in the separation
agreement)yet this time is not being recognized. Can this be true?  Who is
looking out for me?

the utilization pay was contractual. you're still on indefinite layoff, with the opportunity to separate. The papers were mailed out to those employees who management felt were not returning based on business and economics criteria.

Any hope for fuel cells coming to the rochester plant? It's in the contract if
it's going to be produced,it will be done in Rochester.This would really help

Fuel cell production still down the road. But per the MOU signed in 2007, the work is still slated for Rochester.

We prefer that benefit questions be directed to our benefits representatives as many situations need research to get the right answer for each individual. didn't seem to be any updates on the original rumor sight. I just went to
your local union sight and found the updates there. Thanks again for keeping
this sight going. I was resently told by Fedelity that as a Delphi retiree my
pension increase would be paid when they come out of bankruptcy. Thanks again.
 

You are welcome! Both the President and Chairman answer these questions. The pension increase issue is being handled by the International Union and it should be resolved soon.

I have found in more recent years that I have had to defend the UAW and unions
in general from misinformed people that beleave unions have ruined this county
and cause companys to leave the country. As I try to get them to understand
that the only reason they leave is nothing short of corp. greed and that if it
were not for union scale wages there own income would be a lot lower. I say
thanks UAW because if it were not for you not only would'nt I be enjoying a
30 & out retirement but with the Delphi bankruptcy I beleave I would have
been left out in the cold with no more pension or benifits. I say keep up the
good work..........      

 

You hit the nail on the head! Most of us know someone that was shown the door at Kodak or some other non-Union company with little or no benefits to show for years of hard work. The UAW negotiated options for our members: buyouts, buydowns, and early retirements. Bad management decisions put Delphi into bankruptcy, bad management is keeping Delphi in bankruptcy. The UAW will continue to fight for better pay and benefits for American workers - corporations will continue to build up communist China until we change the U.S.Congress. We all can help by voting for UAW endorsed candidates this fall.

They will be offering severence packages to the folks that were laid off indefinitely last year. People hired about on or after 2/1/07 and are on indefinite layoffs will be the ones receiving notices this week/early next.

Because the benefits people are the experts in their field. Everyones case could be slightly different from anothers. So to give a blanket answer to a question, that has possibilities of being different for other employees would be unacceptable.

We're not expected to close. The economy is playing havoc with our product lines. As we speak GM and UAW International are having discussions on remedies for the problems that we are experiencing here locally. We aren't the only Delphi plant feeling the pinch. Its nationwide. Layoffs are all over the auto industry, not just here in Rochester. When we get more info we'll get it out to the members. Again, we are NOT closing, so ignore the rumors out on the floor.

How come we have not had a plant meeting in 2008? We need to know about what is
going on with plant in 2008.


The plant wide "state of the business" meeting is an annual update from management as to how we preformed last year, how we're doing currently, and some projections on the future. The information is based on management targets and goals. Delphi management has made the decision not to hold the meeting this year due to the on-going bankruptcy and the large number of layoffs due to the rapidly changing auto industry.

 The Union portion of these meetings was during the question and answer period at the end of the management presentation. You are welcome to ask any question to us in this forum, "rumor roundup", or come to the next Union meeting, or put in a call for your Union representative. Union meetings will be held on the third Sunday of each month at ten AM beginning in September.

At what age do retirees lose the bridge payment
 

Because of differences in the eligibility age as directed by Federal law and other variables, it is best to contact our benefits office to get all and any pension and retirement benefit  information. We have three very capable representatives in the benefits office full time to answer questions, make phone calls, assist with forms and applications, etc. Please utilize our "experts" for all benefit issues, that's why we have them.

What is the " Delphi Open House"?Is it open to everyone, what hours,
 details, please?

As it states on the homepage, the open house is June 12th 2008 from 7am until 9 pm.  It is a chance for current employees, retirees, and pre-retirees of both Delphi and GM to come and bring their families to tour the plant.  There will be mementos given out and refreshments.  There is no age restriction, if you have small children, they encourage you to bring a stroller.  Everyone entering the building must be wearing closed heel and toed shoes and no High heels are permitted.

Many of us new people don't know or understand that we have a cash balance retierment plan.5.4% of our pay each year is put into a bond.How come we never recieved any mail on this,or yearly statements?This is a totaly different plan.It is not connected to PSP.

All information on retirement and pension can be found by calling the benefits office at 647-7840. They have copies of the supplemental agreement including pension formula. Delphi benefits still mails an annual summary to employees with years of service and pension info.

 

 

Now that the GM SAP has ended, do you know how many will be going to Powertrain and does AAM have transfer rights???

American Axle Manufacturing or AAM Union represented employees do not have flowback rights to G.M. like traditional Union members at Delphi. We have no formal posting of any openings at Tonawanda engine plant at this time.

Dan will the Delphi retirees that did not have the opportunity to check the box be getting the monthly pension increase? If not why not?

You will get everything that a G.M. retiree in your same situation gets. 

 

I am a delphi employee who will have thirty years in 4-months. Could you explain to me what the term " gap closure" mean since no one else has given me a straight answer. hopefully you will be able to help meand a lot of other workers understand this.

The "Delphi Gap" language negotiated in the G.M. contract means that whatever pension increases or "Christmas bonus" monies G.M. retirees get Delphi retirees get - provided they have the same years of credited service, retired under the same contract year, etc. Doing an apples to apples comparison.

The word we got from the Corporation and the International Union is that both the lump sum and the increase for eligible Delphi "check the box" retirees should happen by August.

 

Do you have any idea how many flowbacks Tonawanda Powertrain may be requesting due to the GM S.A.P. ?
 

Last thing we heard was that Tonawanda Powertrain had approximately 150 on layoff and only 120 signed up for SAP retirement. Those numbers are subject to change as some people may wait until the last day to sign up for a SAP, and if the AAM strike ends so may some of those layoffs. We don't believe you'll see overwhelming numbers either way, but we do have area hire status with Tonawanda - so if that's where you'd like to end up put in your flowback application now! 
 

Several months ago there was a letter circulating from a Delphi employee stating that management calculated our "new" pay incorrectly. According to her, it should have been slightly higher. She also sent copies of the letter to the bankruptcy judge, attorney general, local tv station etc. I am unable to find out what the outcome was of the letter. Can you help?

She was wrong, used the wrong formula and the wrong dates to calculate or mis-calculate a cost of living adjustment. We received the proper raise.

 

Herd a few years ago Hillary Clinton came to our union hall on Dewey av.What did she have to say about our union and our jobs?

Senator Clinton was very impressed with our Unionized workforce, our knowledge, skills, and abilities. A few months after her visit she cited our local workers as an example of what's right in America, and that given a level playing field we'd outperform any competition in the world. Senator Clinton made those types of positive comments at the UAW national CAP conference in Washington D.C. It still may be linked on this web site.

 

 

As a retiree of Delphi, IUE-CWA, I am glad the UAW-Delphi retiree's are getting "post employment benefits"...IUE gets zilch...no Christmas bonus, no increases, lump sums and lost the Social Security "creep" or "bridge" whichever you call it, that is a real bummer....we had opportunity to go to UAW but blew it big time....as much as some UAW members complain about their International, it is better than my IUE-CWA and in my opinion the UAW is the best in the country.Your union set the standard for wages and benefits for this entire nation of working men and women...keep up the good work.

We're also proud of the UAW and the work we continue to do in the fight for social and economic justice.

I am a skilled tradesman that was put on indefinate layoff in Oct. What is the latest update on when I will return to work?

As in all times of layoff we need more business before people are called back to active service. Our customer, General Motors, is slow right now and the engine plants that we supply are in layoff mode. There are many reasons for the soft auto market including a bad economy and record high gasoline prices. The auto industry is cyclical and should improve in due time. GM is offering another round of incentive retirement packages so over the course of the next few months some Delphi people with flow back rights may opt to fill openings at GM, creating the need to call back our members from layoff.
 
We are always pushing to put new work in our facility. With enough new work we'd be hiring new members rather than seeing people put out on layoff. 


Is it true that there will be more screw machines brought into the plant soon.
 We haven't been given any word on more machines being brought into the plant
 

Where did our local union by-laws go to? Where can I get a copy of them?

With American Axel back at the bargaining table, how do things look and when will the TLO be over? And will there be a indefinite layoff this year and when?

The management of American Axle must come to the realization that no agreement will be reached until family sustaining, living wage jobs, with good benefits are negotiated. Until Union workers that built that the company share equitably in the profits, the strike will continue. TLO's will continue  that long as well.
We already have some of our members on "indefinite" lay off at this time. Those brothers and sisters will return when auto sales and or normal attrition requires recall of workers. Record high gasoline prices and a horrible economy are hurting automobile sales at this time.


 

Why do some employees still have legal service fee taken out? The contract we voted on said that was to be done away with.

It was reinstated through the efforts of Vice President Cal Rapson and the National UAW leadership.
 

Way to many questions on this site. Employees should be thankful for what they have. I was hired in 67 and was laid off plenty without any pay until I got my year in. We didn't even have chairs to sit on when we did work!! Be happy for the UAW!!

It comes from it will be increased by a percentage equal to the greater of (a) the annual percentage increase in average hourly earnings, excluding overtime, of employees in the manufacturing sector (BLS Series CEU3000000033) or (b) the annual percentage  increase in the All Items, medical, CPI-W Index (1982-84=100) both as calculated for the twelve month period ending with the month of August prior to the respective increase date.
 

Will there be a new product for Loma & canisters in 2008?

We haven't been told of any new work for these areas as of yet

As a 2003 Delphi retiree, can I expect to receive the Christmas bonus in March? Or has my group (2000-2005 retiree) missed the boat on this one? Does the contract being triggered help us out in instances such as this, or not? Thank you for this great website!!!

Yes, at this point

1) What is going in with Delphi, people have been on temp layoff since mid Oct, and the people still working are getting o.t. (WHY) 2) In the fall of 2007 the union told use that we would see a 1.50 raise in January ,now the union is telling people its only going to be a .80 raise. What has changed ? 3) I have been on layoff, but have since past my 1 year , will I start sub pay?

1) the O.T. is minimal  and the layoffs will be ending shortly 2) moving to the floor rate and your 2.54% raise in Jan. 1st for the new people comes to about $1.50 3) if you have a years seniority and than you get laid  off you qualify for sub pay

On Dec. 14th retirees recieve $700 surviving spouses recieve $455 lump sum bonus Dec 10, 2007

Is there any Christmas bonus for retirees in GM's new contract?

UAW GM retirees and surviving spouses whose benefits started before Oct. 1, 2007, will receive four lump-sum payments during the proposed 2007-2011 agreement. They will amount to $700 for all retirees and $455 for all surviving spouses with 30 or more years of credited service. These payments will be made during the month of December in each year of the agreement. The formula used is $23.33 times years of credited service. The minimum payment will be $233.33 and maximum of $700. Surviving spouses will receive 65% of the retiree amount.

It seems the pre-retirement people are in a class of their own, kinda limbo. Considered active employees but pre-retired. The retired get a $700 bonus in December and active and still working a buy-down lump sum. Not much was ever said about pre-retirement people except to contact benefits office but NO BONUS LETTER. Does anyone know if former Delphi works are entitled to any lump sum payments as active or retired are. Thank you.

You get the gap closure. When your retirement date comes up, you get the GM retirement amount along with the December bonuses.

Where was the president or vice-president at today's retirees meeting? With everything that's been happening lately I just can't understand. Could you please answer this question because there was a lot of talk at the meeting about this.

President Dan Maloney is in Detroit on temporary assignment with the International Union, and will return Monday 10/22/07. Acting President Eric Martin was called to attend a Regional meeting with Chairman Mike Rath on Thursday 10/19/07. That is why they were unable to attend the retiree meeting. Highlight books were made available for all retirees who attended the meeting showing any relevant changes affecting retirees. I received my buy down check and it was taxed at around 41%. That seems as if it was taxed as miscellaneous income and not as an earned wage.

It was taxed as miscellaneous wage income: Fed 25%, state 8%, and FICA.

What is the difference between temporary layoff and indefinite layoff? Will the indefinite people be called back and if so about when?

A temporary layoff is a short-term layoff with a return date, whereas an indefinite layoff doesn't give the employee an expectant return date. People will be brought back based on GM's orders, and along the lines of their seniority.

Is it true that if a traditional employee flows back to GM, they will get the new lower wage, instead of the traditional GM wage?

No, it's not true. Traditional flowbacks get the GM traditional wage.

Do people on sub pay pay union dues?

They DO pay dues, but it is only 1 hour of pay per month instead of 2 hrs. It will be taken right out of their sub pay check. I would advise people to keep their sub pay check stubs from the week(s) that the dues come out. Then, if there is any discrepancy as to whether or not they may have paid twice (when they go back to work), I can refund their money. Also, a rule to keep in mind: if any employee (even one who goes out on indefinite lay off) works 40 hrs in any month, even if it is ALL they worked that month, they pay dues. Any idea what kind of medical insurance retirees are going to get under Delphi? How come people that worked over 30 years don't have the option of getting GM coverage when the people with 27 yrs. had that option?

Why is the union not fighting for the people who want to take a voluntary layoff so that it saves people who don't have a year in, who don't get sub-pay?

The union did fight. Bottom line: management has the right to layoff without the use of the voluntary layoff language.

Will Delphi pre-retirees that flow back to GM for retirement purposes get whatever the GM contract gives their retirees?

After the contract is ratified, call Benefits for the details you need.

I recently saw a notice on the bulletin board by LR. It was comparing the traditional employee's max pay rate to what the "new" max pay rate will be. I was told that there was not going to be a max pay rate. We were (are?) supposed to get a "raise " every year of up to 3% based on how the economy is doing or something along those lines. Is there a max pay rate or not?

You can't go lower, but you can go above based on the economy.

What's the chance I'll get my screw machine job back, or am I stuck in production until Jan. 16th when my Coopersville contract is up?

Again, the layoffs are GM volume related. When the orders go back to normal, people will be brought back and then we'll be back to where we were based on seniority.

Will I get subpay if laid off 1 month before my one year?

No, you need to have a year in before you're laid off. Call Benefits if you need more info, 647-7841 or -7840.

Is it true that Union Reps, Officers and appointed folks are at the $18.50 per hour rate?

Not all the reps are at the $18.50 rate, some are in the B and C groups. We're no different than the people we represent.

What's the deal with management doing away with the entire third shift and are you going to do anything about that, or will we hear that they can do that like always?

The entire third shift isn't going away. The temporary reductions and layoffs are due to GM volume decreases.

I retired Aug. 1 0f 2005. Will I be covered under Delphi or General Motors?

Delphi pays the pension at current rate. Payment is guaranteed by GM.

Is there anything in the new GM contract that will change or alter our (Delphi) flowback to GM chances? Thanks.

We have to wait on ratification of the contract first.

As an A-level, the "talks" of our pay scale going up in Jan of 08 has got many A-levels skeptical. (New employees) With everything else the union "Would not sacrifice", and ended up giving all. Is this a guarantee this raise is actually going to take place when the contract says it's going to?

Yes!

Regarding the lay-offs: how long of a period can a person expect to be out? What is the longest period you can be laid off? Will the company recall everybody?

Details on the upcoming layoffs haven't been given and will be based on customer orders numbers. The possible length of a layoff varies with each person's seniority and department.

We haven't seen the tentative agreement yet. GM Shop Chairman and Presidents get updated Thurs. and Fri.

Could you please clarify an earlier answer pertaining to the $35,000 lump sum buy down, if we take a TLO or are laid off after October 1st 2007 will the buy down amount be affected in any way?

Any lay off will not affect the first $35000 payment, but will however effect the second and third. Correct?

TLO's do not affect the $35,000 buy down in the second and third installment. If there were to be changes, everyone who is on TLO would be grandfathered in and no losses would affect that person.

What day will we be getting our buy down payment? I was told Oct. 5, now I am hearing it will be Oct. 11.

Why is the union hall closed so early(3:30pm)when most of the people that use it, are on day shift? They get out at 3:18 pm. It should be opened at least until 4:30 pm, so that people have time to come from the plant and use their hall.

Starting Oct.1st, hours will be back to 7:30am to 4:00pm.

Any realistic chance that truckers will get anything more than $14.50/hr? Or are we stuck for 4 years making less than the workers whose cells we keep running? I think that it is unfair that we went from a "B" level pay to the bottom of the barrel.

There is a demand on the table at negotiations to upgrade the truckers.

Will GM enforce a pay cut and pay employees $16.50 with a huge signing bonus of $50,000 as an incentive to its employees?

We have NO knowledge of what is being negotiated at the international level my brother. When word is available your local will give info!

I've heard that everyone will be losing the BluePoint 2 insurance plan and be getting standard BC/BS in its place. Will this be true for the pre-retirees? Also, those retiring as "GM employees" are automatically enrolled in the traditional BC/BS. Is this because of the area we live in? In other locations GM retirees enjoy HMO's if they are available. What do the retirees get in the Buffalo region? And, what is going to happen to the health care of the Delphi retirees that were out before this mess all started?

Your best source for the most current information about health care questions is the Benefits Department. They can explain the particular circumstances of each member's coverage.

As a pre-retiree, I received a letter to apply for TRA benefits for some job training. Now I just got another letter from NYS Dept. of Labor saying that I am not eligible for any TRA. Can you explain?

I recently received a letter from TRA stating that I am not eligible as a preretiree because I am not eligible for unemployment benefits. How did the people out west get TRA?

This is a federal government benefit, not a UAW benefit, for which we petitioned the Dept. of Labor. They do the determination as to eligibility. ( Form 722E reports eligibility for several types of TRA assistance; you probably are still eligible for Trade Adjustment Assistance as discussed in the first paragraph of the form you received. This assistance is generally used for training and can be up to $12000 with no time limits. --webmaster)

Is it true that as of October we will no longer have free legal services? If so does that apply to pre-retirement and retirees as well?

Delphi employees won't have them, but those pre-retirees and retirees get what GM has because they checked the box. As long as it's still part of the new contract they will retain the legal services.

If we accept a TLO, or have a layoff handed to us, will that time off affect the buy-down money in any way?

Are the retirees and the Pre-retirees still going to get the Christmas bonus. As they did in the previous years?

When the contract is settled we'll be able to give you an answer.

I asked the question below about about class C production workers going to 15.30. Thank you for being patient and answering my questions but I have another. What is the meaning of "floor rate"? Also I hear that we are supposed to go to 15.30 on 12/31 and then in January we would get another increase to whatever the wage formula of the MOU is. Is this true?

Floor rate is the rate 2nd tier workers will be at across the plant and yes you'll get an increase in January.

The new starting wage for class C production workers, I was told, is $15.30 starting in January, 2008. Now the traditional employees are going to the max for level C which is around $16.50. I will have 1 1/2 years by December; wouldn't people like me go to the level that they would be at for 1 1/2 years since the new starting wage is 15.30?

It's not the new starting wage, it's the floor rate starting in January 2008. Anyone being newly hired, would start at $14.00 and be considered temporary.

Why do supplemental employees employees have to pay for the PSP class and it is offered for free to everyone else? PSP is a Delphi benefit. Why would we have to pay anything, let alone $499.00 just for the knowledge to use it. Does that seem right to you?

The traditional people still have tuition assistance until Oct. 1st. Supplemental employees don't have tuition benefits. The class was brought in so the folks being bought down could fully understand how to use their money in the most advantageous way. This class isn't just PSP info; it covers a wide variety of topics.

When will the monthly union meetings be starting up again?

In regards to our $35,000 buydown, if I currently have 10% of my pay put into my PSP, will 10% be deducted from the buydown check? They told us it would be taxed, etc. like a regular paycheck.

To make Delphi Rochester more competitive in order to get future work, why don't our President(Dan Maloney) & Shop Chairman (Mike Rath) DEMAND that salary people at the Engineering Center(500 people) and LEX (300 people) give up at least $10.00 an hour, so that they can HELP preserve their jobs. Why is it always on the shoulder of the blue collar worker?

I'm told the only way you can get vacation for Jan. 2,3,4th of 2008 if you have vacation left over from 2007 is this true?

Yes, because the holiday and days fall on a split week from the previous year, 2007.

I check your website often. My husband is an IUE Warren, OH retiree. We felt forced by our union to leave after only 15 yrs at Delphi and approaching 60 yrs. old. I would also like to commend you for addressing so many concerns. The Warren facility was sold out by our union many years ago when they went with the CWA. Seventy five percent of the employees left so that gives you some idea of what the union leaders told us. It appears now that a good percentage of people who were GM employees prior to 1999 probably would have been OK for at least 3 more years. Watch for a big lawsuit against the IUE/CWA. A local group has already been in our newspaper the Warren Tribune asking for members to bring in documentation of what they were told at meetings. I am not involved, just passing this along as a point of interest. Thanks again for so much info.

I put in for a shift preference as a temp employee in March; when I was hired as a permanent employee I again put in a shift preference move. That was 3 weeks ago. In that time I have seen many employees with less seniority than me moved. What is management doing? Or better yet how are they getting away with it? Does seniority mean nothing?

It will depend on the wage formula in the MOU. While there is no way of accurately predicting how the formula's production worker wage and inflation components will perform in the future, based on the results over the last decade the formula would have generated increases of about 3% per year.

When was the meeting on TRA? I'm pre-retired and never was notified. Also, am I required to take the training/job search in order to get any compensation? This is the 2nd time I've written without a response.

The TRA meeting was in the plant for the working members contemplating their options before the Aug. 17th deadline. You need to go to RochesterWorks and set up an account for TRA benefits after you send your reply/petition back that you received in the mail.

Rumor has it all of third shift is going to be laid off (as in all lights off all over the plant). How do you go about picking who gets laid off? Is it by seniority, or is it across the board, everyone on third no matter what their hire date?

Please, again, don't listen to rumors; there have been NO talks of laying off third shift entirely. Later this year there will be temporary layoffs, but to what extent and shift, at this time we don't know.

Were there any changes in benefits for current retirees negotiated in the new contract?

The new contract for the retirees is being negotiated nationally in Detroit. Any questions about changes in coverage should be directed to the benefits department.

We noticed that some people that we know have submitted questions that have not been printed. Do you pick and choose what you want to answer?

Rumor Roundup was never meant to replace the methods the union operates under as defined by the UAW Constitution, local bylaws, and Federal legislation. It is a testimonial to our leaders' efforts that so many have come to rely on the information found in Rumor Roundup, but it is sad that so many expect immediate answers to questions often more appropriately answered by their committeepersons, the benefits department, or by attending monthly membership meetings. Rumor Roundup is not a mandated duty of our president or shop chairman and other official duties must take precedence. Some questions require time for research and interaction with management to properly answer, some questions cannot be answered due to business liability, and some questions are more comment than inquiry. Who can run for a committeeperson position and can everybody vote? It is my understanding that only people who have attended 3 union meetings can vote. Unfortunately, I think that leaves out a lot of people! Also what exactly is a union member in good standing?

UAW members in good standing are allowed to vote after 30 days in the Union including those who Delphi management calls temporary. If you have one or more years of plant seniority and are in good standing you are entitled to run for an elected position. When elections are posted, you need to go to the union hall during the sign-up period to be put on the ballot. A member is considered in good standing as long as dues monies are paid (and all debts are paid to the UAW) and good standing status wasn't lost through the trial procedure spelled out in the UAW constitution.  It is rare that a member loses good standing status. You must be a member in good standing to be eligible for strike pay. Crossing a strike line will put you in bad standing with the Union immediately. Attendance at a majority of union meetings is required by our bylaws for those who hold union positions or serve on union committees.

Is Delphi still involved in the fall auto negotiations or has this been taken care of by the contract just negotiated?

Delphi isn't involved in the fall negotiations nationally. Just the Big 3: GM, Ford and Chrysler. Delphi only has locals doing C.O.A.'s (Competitive Operating Agreements).

Did something in our current contract change? I was told by a committeeperson that if you get laid off this fall they did NOT have to call you back. How true is this?

The layoffs, whenever they happen, will be temporary, and you'll be called back.

That was the only time we could get the conference call set up with N.Y. State Dept. of Labor.

I just became a setup (01A). When can I put in a shift preference; is it right away or not until I hold the class? I have received different answers from different union officials.

Lately, LR (Labor Relations) has been using contractual language to make you obtain the class first so that training is not wasted and there is less movement. Put your shift preference in anyway. Then, after two weeks call for your committeeperson to see what's going on.

There have been too many rumors out there about the October layoff. Could you give us the best possible idea of what is going to happen? How long would it be?

Layoff talks are aimed at a November time frame now. Remember, the layoffs are based on GM's orders and the time frame could change. Length of time, no one knows at this point. Layoffs will be temporary.

Do you have any news for us on the local agreement? How is it going? Is it going to go to the floor for a vote?

Local negotiations are going slow, but the agreement will go to the floor to be ratified.

I have heard that some of our committeepersons are leaving. How will these positions be filled?

Elections. Temporary fill-ins, in other words, alternates or alternates-to-alternates will cover for the short term.

I was hired in August of 1998. Am I eligible for the additional 7 years of GM retirement?

Yes.

Why are people being required to work mandatory overtime when there are rumors of pending layoffs in the fall? It makes no sense to mandate O.T. only to lay people off.

By the current contract they can make you work 9 hour days and two out of three Saturdays.

How often do you update the Rumor Roundup? Today is the 17th of August and the last answer I see is from August 10th.

Under the new contract, will new-hires get a pension after 5 years of service?

Delphi will provide annual contributions equal to 5.4% of wages to each employees Individual Retirement Plan (IRP) account. These accounts will accrue with interest credited annually at the 30 year US Treasury Bond rate. Plan assets will be retained in a pension trust subject to vesting and portability provisions. There will be NO provisions for supplements, temporary benefits, or 30 and out retirement, although 85-point retirement remains, so far. Annuities with lump sum options will be available. Employees are vested after 5 years, meaning they can take out what they put in or move it, but their pension is based on what they put into the IRP account and the percentage matched by Delphi. They can move their money around in the fund easily or into another plan if they leave here.

Can employees who transferred to Rochester from Coopersville sign up to flow back to the Delphi in Michigan?

Permanent employees covered under the supplemental agreement may sign up for a Delphi to Delphi transfer by calling 1-800-NAT-HIRE. You will need the CISCO code of the plant you wish to transfer to. You can find CISCO codes by asking in the hourly personnel office; there is more than one Delphi plant in Michigan.

If we take a buyout, how is it worded to the Dept. of Labor? Lack of work? Can we get unemployment considering we left by choice and could still be employed at the lower rate?

If the new contract states that they will keep 4 plants open, Lockport being one of them, how can the union allow management to close Lockport because their membership voted the contract down? Or was the deal that we agree to close any plant that does not vote yes? If so, is that legal to do? I bet that you don't answer this question on Rumor Roundup.

Dan Maloney: The MOU (memorandum of understanding) was ratified by the UAW membership nationwide at Delphi. One of the provisions, Attachment A-1, "Lockport Product Plan," shows that Lockport will have work through this agreement and even out into the years 2015/2016. No one knows what the 2011 agreements will bring for any location, but our Union will not allow management to violate the MOU. Short answer--Lockport isn't closing.

Mike Rath: The new contract says that the four plants have work guaranteed for a certain amount of years. The Keep Plants must also come up with a Competitive Operating Agreement (COA) that makes them competitive for new work and the work allocated to them in the MOU. For a plant that doesn't create one, remaining in business after the year 2011 will be difficult.

Webmaster: You lost your bet; here's what you owe: you must open your eyes and see that your union works for you, for your interests, and by your consent and participation. You must clear your eyes of rumors and presumptions of closed-door dealings, which are prohibited by collective bargaining legislation. Have faith, and pass it on.

When we get our first lump sum in Oct., will the taxes automatically be taken out or will we have a choice? If so, will it be be both Federal and State taxes deducted from this sum?

It will be taxed as wages earned.

Do you have any idea which departments are going to be laid off and for about how long?

Anyone on active status as of Aug.1 2007, will receive a one-time payment of $350.00 during the week of Aug.6th.

Are the Traditional employees going to get the $600.00 Health Care Spending Account and can that $600.00 be used for doctor visits that we will now have to pay under the Traditional Blue Cross/Blue Shield?

Traditionals, as of Oct. 1, 2007, will have the same healthcare benefits that are under the Supplemental Agreement. The list of the benefits are in the Benefits department at the plant.

I retired previous to "check the box" in 2005 from Delphi. Now that our GM guarantee has been triggered, how soon can I expect to see my Pension check start coming from the GM plan instead of the Delphi plan? I have been looking forward to this! Thanks

If you retired after Jan. 1, 2000, but prior to Oct. 1, 2005, Delphi pays pension at current rate in effect the day before the effective date. Payment is guaranteed by GM and GM assumes OPEB liability. If you retired on or after Oct. 1, 2005, and prior to the freeze date, Delphi pays pension at current rate, GM guarantees payment, and GM assumes OPEB liability.

If we have less than one year and get laid off we will only get 26 weeks of unemployment. Is there some kind of extension with New York or do we need to just find another job?

We don't anticipate any layoff to be six months long. An extension of unemployment benefits question should be directed to the NY Dept. of Labor.

I am a retiree as of 2004. I would like to know if there is going to be a co-payment for our health care benefits since the contract has been ratified?

I work in Lockport, NY. We just recently had elections for shop committee and a guy who was removed from a Doc. 46 internationally appointed job almost won. Can we put in a local bylaw that states no one removed from office by the international union be allowed to hold an elected or appointed position?

That is all decided at the local, under their by-laws. Bring your concerns up at your monthly membership meetings.

When are we going to start seeing GM flowback openings posted again now that Delphi people have closed plant status and GM has temp workers in almost all their plants?

The postings come from Labor Relations; when they start coming in they'll be posted.

I heard that once we are reduced to the lower wage and benefits, if we flow back to GM, we still will be at the lower wage and benefits. Is this true?

No.

How come the local union hasn't shared any information with the local membership about the opportunities for TRA or TAA should they decide to leave the company? People are going to be making life changing decisions and should have as much info as possible. This information has been around for quite sometime: The application was submitted last year and the decision was certified on 6/8/07.

We don't have the exact information on each employee. The benefit as stated before is different for each person! You need to get in touch with the Dept. of Labor for specific information pertaining to you on this subject. This is a Federal government program, not a UAW benefit and can be researched online.

I am a traditional employee who will be taking the buydown package. I understand that you must be at work on October 1 in order to receive the $35,000. I am going to have surgery in Oct 07 and will be out of work 4-6 weeks. I know that will effect my $35,000 for Oct 08, but do you know if it will be pro-rated by days not worked, weeks not worked or if they will just take a chunk because I did not work all year?
