Is there any Christmas bonus for retirees in GM's new contract? UAW GM retirees and surviving spouses whose benefits started before Oct. 1, 2007, will receive four lump-sum payments during the proposed 2007-2011 agreement. They will amount to $700 for all retirees and $455 for all surviving spouses with 30 or more years of credited service. These payments will be made during the month of December in each year of the agreement. The formula used is $23.33 times years of credited service. The minimum payment will be $233.33 and maximum of $700. Surviving spouses will receive 65% of the retiree amount. Oct. 22, 2007 It seems the pre-retirement people are in a class of their own, kinda limbo. Considered active employees but pre-retired. The retired get a $700 bonus in December and active and still working a buy-down lump sum. Not much was ever said about pre-retirement people except to contact benefits office but NO BONUS LETTER. Does anyone know if former Delphi works are entitled to any lump sum payments as active or retired are. Thank you. You get the gap closure. When your retirement date comes up, you get the GM retirement amount along with the December bonuses. Oct. 22, 2007 Where was the president or vice-president at today's retirees meeting? With everything that's been happening lately I just can't understand. Could you please answer this question because there was a lot of talk at the meeting about this. President Dan Maloney is in Detroit on temporary assignment with the International Union, and will return Monday 10/22/07. Acting President Eric Martin was called to attend a Regional meeting with Chairman Mike Rath on Thursday 10/19/07. That is why they were unable to attend the retiree meeting. Highlight books were made available for all retirees who attended the meeting showing any relevant changes affecting retirees. Two benefit representatives attended the meeting to answer all and any questions (normally only one attends). We continue to serve and support our retirees, and appreciate your support in return. A win-win situation! Oct. 22, 2007 I received my buy down check and it was taxed at around 41%. That seems as if it was taxed as miscellaneous income and not as an earned wage. It was taxed as miscellaneous wage income: Fed 25%, state 8%, and FICA. Oct. 15, 2007 What is the difference between temporary layoff and indefinite layoff? Will the indefinite people be called back and if so about when? A temporary layoff is a short-term layoff with a return date, whereas an indefinite layoff doesn't give the employee an expectant return date. People will be brought back based on GM's orders, and along the lines of their seniority. Oct. 15, 2007 Is it true that if a traditional employee flows back to GM, they will get the new lower wage, instead of the traditional GM wage? No, it's not true. Traditional flowbacks get the GM traditional wage. Oct. 15, 2007 Do people on sub pay pay union dues? They DO pay dues, but it is only 1 hour of pay per month instead of 2 hrs. It will be taken right out of their sub pay check. I would advise people to keep their sub pay check stubs from the week(s) that the dues come out. Then, if there is any discrepancy as to whether or not they may have paid twice (when they go back to work), I can refund their money. Also, a rule to keep in mind: if any employee (even one who goes out on indefinite lay off) works 40 hrs in any month, even if it is ALL they worked that month, they pay dues. How come people that worked over 30 years don't have the option of getting GM coverage when the people with 27 yrs. had that option? The union did fight. Bottom line: management has the right to layoff without the use of the voluntary layoff language. It was comparing the traditional employee's max pay rate to what the "new" max pay rate will be. I was told that there was not going to be a max pay rate. We were (are?) supposed to get a "raise " every year of up to 3% based on how the economy is doing or something along those lines. Is there a max pay rate or not? You can't go lower, but you can go above based on the economy. Sept. 26, 2007 Could you please clarify an earlier answer pertaining to the $35,000 lump sum buy down, if we take a TLO or are laid off after October 1st 2007 will the buy down amount be affected in any way? Any lay off will not affect the first $35000 payment, but will however effect the second and third. Correct? TLO's do not affect the $35,000 buy down in the second and third installment. If there were to be changes, everyone who is on TLO would be grandfathered in and no losses would affect that person. Revised Oct. 11, 2007 What day will we be getting our buy down payment? What do the retirees get in the Buffalo region? And, what is going to happen to the health care of the Delphi retirees that were out before this mess all started? Sept. 20, 2007 As a pre-retiree, I received a letter to apply for TRA benefits for some job training. Now I just got another letter from NYS Dept. of Labor saying that I am not eligible for any TRA. Can you explain? I recently received a letter from TRA stating that I am not eligible as a preretiree because I am not eligible for unemployment benefits. How did the people out west get TRA? This is a federal government benefit, not a UAW benefit, for which we petitioned the Dept. of Labor. They do the determination as to eligibility. ( Form 722E reports eligibility for several types of TRA assistance; you probably are still eligible for Trade Adjustment Assistance as discussed in the first paragraph of the form you received. This assistance is generally used for training and can be up to $12000 with no time limits. --webmaster) Sept. 20, 2007 Is it true that as of October we will no longer have free legal services? If so does that apply to pre-retirement and retirees as well? Delphi employees won't have them, but those pre-retirees and retirees get what GM has because they checked the box. As long as it's still part of the new contract they will retain the legal services. Sept. 20, 2007 If we accept a TLO, or have a layoff handed to us, will that time off affect the buy-down money in any way? Sept. 20, 2007 I asked the question below about about class C production workers going to 15.30. Thank you for being patient and answering my questions but I have another. What is the meaning of "floor rate"? Also I hear that we are supposed to go to 15.30 on 12/31 and then in January we would get another increase to whatever the wage formula of the MOU is. Is this true? Floor rate is the rate 2nd tier workers will be at across the plant and yes you'll get an increase in January. Sept. 20, 2007 The new starting wage for class C production workers, I was told, is $15.30 starting in January, 2008. Now the traditional employees are going to the max for level C which is around $16.50. I will have 1 1/2 years by December; wouldn't people like me go to the level that they would be at for 1 1/2 years since the new starting wage is 15.30? It's not the new starting wage, it's the floor rate starting in January 2008. Anyone being newly hired, would start at $14.00 and be considered temporary. Why do supplemental employees employees have to pay for the PSP class and it is offered for free to everyone else? PSP is a Delphi benefit. Why would we have to pay anything, let alone $499.00 just for the knowledge to use it. Does that seem right to you? The traditional people still have tuition assistance until Oct. 1st. Supplemental employees don't have tuition benefits. The class was brought in so the folks being bought down could fully understand how to use their money in the most advantageous way. We felt forced by our union to leave after only 15 yrs at Delphi and approaching 60 yrs. old. I would also like to commend you for addressing so many concerns. The Warren facility was sold out by our union many years ago when they went with the CWA. Seventy five percent of the employees left so that gives you some idea of what the union leaders told us. It appears now that a good percentage of people who were GM employees prior to 1999 probably would have been OK for at least 3 more years. Watch for a big lawsuit against the IUE/CWA. A local group has already been in our newspaper the Warren Tribune asking for members to bring in documentation of what they were told at meetings. How much every 6 months? It will depend on the wage formula in the MOU. While there is no way of accurately predicting how the formula's production worker wage and inflation components will perform in the future, based on the results over the last decade the formula would have generated increases of about 3% per year. August 27, 2007 When was the meeting on TRA? I'm pre-retired and never was notified. Also, am I required to take the training/job search in order to get any compensation? This is the 2nd time I've written without a response. The TRA meeting was in the plant for the working members contemplating their options before the Aug. 17th deadline. You need to go to RochesterWorks and set up an account for TRA benefits after you send your reply/petition back that you received in the mail. August 27, 2007 Rumor has it all of third shift is going to be laid off (as in all lights off all over the plant). How do you go about picking who gets laid off? Is it by seniority, or is it across the board, everyone on third no matter what their hire date? Please, again, don't listen to rumors; there have been NO talks of laying off third shift entirely. Later this year there will be temporary layoffs, but to what extent and shift, at this time we don't know. August 27, 2007 Were there any changes in benefits for current retirees negotiated in the new contract? The new contract for the retirees is being negotiated nationally in Detroit. Any questions about changes in coverage should be directed to the benefits department. August 27, 2007 We noticed that some people that we know have submitted questions that have not been printed. It is a testimonial to our leaders' efforts that so many have come to rely on the information found in Rumor Roundup, but it is sad that so many expect immediate answers to questions often more appropriately answered by their committeepersons, the benefits department, or by attending monthly membership meetings. Some questions require time for research and interaction with management to properly answer, some questions cannot be answered due to business liability, and some questions are more comment than inquiry. In short, every question is read, but only most are answered. --webmaster August 27, 2007 Who can run for a committeeperson position and can everybody vote? It is my understanding that only people who have attended 3 union meetings can vote. Unfortunately, I think that leaves out a lot of people! Also what exactly is a union member in good standing? UAW members in good standing are allowed to vote after 30 days in the Union including those who Delphi management calls temporary. If you have one or more years of plant seniority and are in good standing you are entitled to run for an elected position. When elections are posted, you need to go to the union hall during the sign-up period to be put on the ballot. A member is considered in good standing as long as dues monies are paid (and all debts are paid to the UAW) and good standing status wasn't lost through the trial procedure spelled out in the UAW constitution. It is rare that a member loses good standing status. You must be a member in good standing to be eligible for strike pay. Crossing a strike line will put you in bad standing with the Union immediately. Attendance at a majority of union meetings is required by our bylaws for those who hold union positions or serve on union committees. Aug 25, 2007 Is Delphi still involved in the fall auto negotiations or has this been taken care of by the contract just negotiated? Delphi isn't involved in the fall negotiations nationally. Just the Big 3: GM, Ford and Chrysler. Delphi only has locals doing C.O.A.'s (Competitive Operating Agreements). Aug 21, 2007 Did something in our current contract change? I was told by a committeeperson that if you get laid off this fall they did NOT have to call you back. How true is this? The layoffs, whenever they happen, will be temporary, and you'll be called back. Aug 21, 2007 I just became a setup (01A). When can I put in a shift preference; is it right away or not until I hold the class? I have received different answers from different union officials. Lately, LR (Labor Relations) has been using contractual language to make you obtain the class first so that training is not wasted and there is less movement. Put your shift preference in anyway. Then, after two weeks call for your committeeperson to see what's going on. Aug 21, 2007 There have been too many rumors out there about the October layoff. Could you give us the best possible idea of what is going to happen? How long would it be? Layoff talks are aimed at a November time frame now. To reiterate: No. Aug 10, 2007 With a May 3, 1999 seniority (hire) date, am I eligible for the additional 7 years of GM retirement? I have heard that I would have had to be there for 90 days before May 28, 1999. No, sorry. Revised Aug 10, 2007 Under the new contract, will new-hires get a pension after 5 years of service? Delphi will provide annual contributions equal to 5.4% of wages to each employees Individual Retirement Plan (IRP) account. These accounts will accrue with interest credited annually at the 30 year US Treasury Bond rate. Plan assets will be retained in a pension trust subject to vesting and portability provisions. There will be NO provisions for supplements, temporary benefits, or 30 and out retirement, although 85-point retirement remains, so far. Annuities with lump sum options will be available. Employees are vested after 5 years, meaning they can take out what they put in or move it, but their pension is based on what they put into the IRP account and the percentage matched by Delphi. They can move their money around in the fund easily or into another plan if they leave here. Revised August 10, 2007 Can employees who transferred to Rochester from Coopersville sign up to flow back to the Delphi in Michigan? Permanent employees covered under the supplemental agreement may sign up for a Delphi to Delphi transfer by calling 1-800-NAT-HIRE. You will need the CISCO code of the plant you wish to transfer to. You can find CISCO codes by asking in the hourly personnel office; there is more than one Delphi plant in Michigan. Aug 10, 2007 If we take a buyout, how is it worded to the Dept. of Labor? Aug 07, 2007 If the new contract states that they will keep 4 plants open, Lockport being one of them, how can the union allow management to close Lockport because their membership voted the contract down? Or was the deal that we agree to close any plant that does not vote yes? If so, is that legal to do? I bet that you don't answer this question on Rumor Roundup. Dan Maloney: The MOU (memorandum of understanding) was ratified by the UAW membership nationwide at Delphi. One of the provisions, Attachment A-1, "Lockport Product Plan," shows that Lockport will have work through this agreement and even out into the years 2015/2016. No one knows what the 2011 agreements will bring for any location, but our Union will not allow management to violate the MOU. Short answer--Lockport isn't closing. Mike Rath: The new contract says that the four plants have work guaranteed for a certain amount of years. The Keep Plants must also come up with a Competitive Operating Agreement (COA) that makes them competitive for new work and the work allocated to them in the MOU. For a plant that doesn't create one, remaining in business after the year 2011 will be difficult. At our roll out meetings held in the Training Center on 6/24/07 two large overhead screens showed the entire attachment A-1 for Rochester including new products, programs, increased revenues, and the future headcount projections you reference. It means that if Delphi couldn't fulfill their pension obligation to you in the future, GM would guarantee your pension and benefits. The GM guarantee has been triggered for the group of our brothers and sisters that retired between January 2000 and October 2005 who were Delphi retirees and never had the chance to "check the box" like all of our SAP participants did in 2006. Now GM will underwrite or guarantee that you continue to receive your hard earned pension even if Delphi goes out of business. The UAW has a long proud history of caring for our retirees. The union leadership gets their O.T. based on how many people are scheduled to work O.T. in the districts that they represent. The bankruptcy court would have the option of voiding our contracts and imposing the last offer of management - no buyouts, no buy downs, no early retirement or flowback provisions - just less benefits and lower wages. At that point the UAW has the option to strike. The offers made by GM wouldn't exist because the agreement was turned down. There are no guarantees that GM will offer them again. June 22, 2007 What does it mean to be a member in good standing? What does one do to be in bad standing? A member is considered in good standing as long as dues monies are paid (and all debts are paid to the UAW) and they haven't lost good standing status through the trial procedure spelled out in the UAW constitution. Dues collection is automatic in a closed shop like ours, and isn't normally a problem. It is rare that a member steps so far out of line or is so detrimental to the Union that they must be brought up on charges and lose "good standing" status. You must be a member in good standing to vote in Union elections or run for Union office, and to be eligible for strike pay. Crossing a strike line will put you in bad standing with the Union immediately. I thought moves (ex: 63B & shift preference) were contractual. How can our union let this happen? Our union is supposed to act in the best interest of the workers, not the best interest of the company. That is what we pay you for. What did we get in return for this agreement? Lack of adequate training and triple levels of scrap throughout the plant led to the temporary freeze. First time quality is a must if we are to gain new and/or replacement work in the future. The issues are so important that Director Guy Hachey is talking to the plant manager on a weekly basis, if not more, to see why costs at the Lexington facility have increased. The freeze is just temporary and movement is scheduled to begin again May 9th. March 20, 2007 When we were on TLO we were still collecting a check and getting unemployment benefits. Unemployment always asks, are you ready, willing, able to work, and when was your last day that the company let you work. How is pre-retirement different? We are on the books as active but told that we can't come to work. When you were on TLO the company laid you off with the intent that you would be coming back to the workforce. With the pre-retirement you signed the agreement that would allow you to leave while earning a set income based on your seniority until you got to your 30 years and became a retired employee. The New York State Unemployment office will answer any questions you have. UAW Region 9 has stated that pre-retirees are considered active employees by the corporation, collecting wages, and, as such, are not eligible to collect unemployment benefits. Engineering fixes are underway to ensure that fresh air (make up air) is drawn in at a 15%-20% rate. It was said to be a mistake and checks thereafter did not have the 200 hours on them. Now my checks have the 200 hours back on. Do you know why? It is just a clerical glitch. March 03, 2007 Are the Skilled Trades wages going to be reduced? I heard the company is just using the high wage to attract new workers. However, once they have enough, they are going to push for a lower wage. Can they do this? No one can predict what the outcome of the bankruptcy proceedings will be, or what we'll win in negotiations. What we do know is that the UAW will fight for the highest wage and benefit package possible. As always when new information becomes available, we'll get it out. Can you get Verizon to extend their nationwide Delphi 20% wireless cell phone discounts to retirees and pre-retirees? Movie and carwash tickets are available at the retiree monthly meeting. Call Verizon to verify eligibility for discounts. Feb. 20, 2007 I have attended many of our membership meetings. Why is it that the new benefits people do not have to attend and give us a report? Are they required to through our bylaws? What can be done about this? Appointed and elected officials are required to attend two out of three membership meetings unless they are excused. Our new reps have been excused when out-of-town for training - but they should be attending more meetings as the training needs are met. Feb. 20, 2007 I work at Delphi in Lockport. Recently there was a Unity News update on the Sub Council Highlights ending Jan. 31st. In the news update they referred and I quote "The investor groups are claiming that the labor agreements we have are too rich and are only willing to pay less than the supplemental agreement which expires in 2011." Could you elaborate on this supplemental agreement as I had not been aware of it and believe a lot of our membership may not be aware of it also. The Supplemental Agreement covers all of the "new hires" at Delphi, those who make $14 an hour in production to start. The new investment group thinks that is too much! That's part of the reason why we don't have an agreement. Feb. 20, 2007 Any more info' on the TRA assistance? We have been informed that all TAA/TRA will be handled by the regional office; we have forwarded all requests and information to the region. As more information becomes available we'll put it on this site and get it out in membership meetings. Feb. 20, 2007 What is TRA assistance ? The Trade Readjustment Act (TRA) or Trade Adjustment Allowance (TAA) provides training dollars and, in some cases, wage supplements for workers who have been put out of work due to foreign competition. We have applied through our Regional office to get these funds for our members - no word so far. Feb. 20, 2007 Will the UAW give up or freeze the pension and health care benefits in the '07 contract? We have demand resolutions on both pension and health care for the upcoming round of contract negotiations. The UAW has a long proud history of negotiating top notch retirement and health care benefits for our members, but we'll need every sister and brother to stand ready to take action when and if we're called on. Negotiations can only take us so far-a single payer, universal health care plan for our nation is the ultimate answer for health benefits. New laws are needed to punish corporations that use bankruptcy to steal workers pensions. We all need to be active in the political process to help ourselves! Feb. 20, 2007 I still own stock in DPHIQ. In your opinion, what will happen to the stock when the bankruptcy is final? Most investment guru's will tell you it's not a good idea to buy stock in the company you work for - something about putting all your eggs in one basket comes to mind. We can not and will not offer any opinion beyond that on stocks and or investing. Feb. 20, 2007 How do we recent retirees (7/06) get more specific info on our new GM retiree health care? There are no specifics concerning deductibles, co-pays, etc., and their lines are constantly busy. Why were we not sent info before our insurance was changed? Was it done this way so we were notified after 1/1/07 to prevent us from changing our minds and taking the $140,000 instead of our full retirement? Feb. 20, 2007 What are the changes in the medical benefits to retired workers that have obviously already taken place? Went to the doctor today and they said that Delphi co-pays and benefits have changed, but we have received nothing in the mail regarding this! The company pulled this a couple of years back when they switched us to Blue Cross Blue Shield of Michigan without letting anyone know in advance and it took months to straighten out that mess. Feb. 20, 2007 I work in the new Coopersville clean room. There have been spills lately. I hear the fluid they use to test the injectors causes cancer. When a spill does happen are they supposed to evacuate the area? Its kind of scary. I love my job but I don't want to die for it. Any time a spill occurs the Health & Safety department needs to be called immediately; they have a meter that can detect vapors in the air. The Stoddard solvent used to test injectors is not listed as a cancer causing agent on the MSDS. The OSHA standard is no more than 100 parts per million (PPM); we typically run at half of that amount or less according to our health and safety people. A rule of reason must be used by the people in the area, including the area supervisor if a spill occurs as to how fast we need to evacuate, or if we need to evacuate at all. A large spill requires fast action; if it's only a small drop, proper clean up will generally contain the problem. Feb. 20, 2007 Are there still temporaries working at the Tonawanda engine plant? If so, why is that allowed when Delphi people are seeking flowback to that location? There are NO temporary employees at this time at Tonawanda. Remember Lockport is in the area hire, we are not. Feb. 20, 2007 I have in for a transfer to GM. I am hearing that GM stopped calling Delphi workers and are having their own people from GM go first. GM will call people on the flowback list from Delphi as openings occur. They will prioritize based on issues such as plant closings, area hire, extended area hire and seniority. Feb. 20, 2007 I hear that the H & M outside non-union contractors may be staying another 6 months or so after the Coopersville move to do more of our construction jobs now that we have been reduced to a skeleton crew. Is there any truth to that? No. At this date management has not approached the Shop Chairman about this matter. Feb. 20, 2007 Is the Union going downhill now that laborers are doing painter's and carpenter's work in the Henrietta plant? I thought the union worked all these years to get contracts that protected the skilled trades. This is not the way it is supposed to go. The painter class was totally depopulated by the attrition packages offered and accepted. The Union is working to repopulate from within using paragraph 152. The Union is using the grievance process and negotiations to make this happen. You can help by putting in an official call for your committeeman and giving all relevant information. Jan. 18, 2006 Do you think that Delphi will default on the pension, health care, and insurance and that the GM guarantee will kick in? They have until Oct. of this year. The International UAW is party to these ongoing negotiations, and they will notify all the local Unions when and if the GM guarantee is triggered. It has not been triggered as of this date. Jan. 18, 2006 I left Delphi in August 2006 thru the pre-retirement program. I am now hearing something about a Christmas bonus we are going to get. Is this true and if so when will we get a check? Retirees who retired on or prior to Oct. 1, 2003, will receive a lump-sum payment of $800 and surviving spouses will receive 65 percent of this amount or $520. Jan. 18, 2006 Are the people who left under pre-retirement eligible for TRA assistance like the plants in the mid-west? We have started the application process and are working with UAW Region 9 reps to make sure this is done properly. Jan. 18, 2006 I took the pre- retirement package. When my checks started to come in this year I noticed my check has 200 hours of vacation time on it. What does this mean to me? Will I get money at the end of the year for vacation pay? It was a mistake; it will be corrected. Jan. 18, 2006 Can you please say if there are going to be more attrition packages for the remaining people with seniority (i.e., 23 years or more). Is there any guarantee for 23 years or more, as has been rumored? We have no information on any future attrition packages at this date,12/27/06. The 23 year guarantee is still unresolved - We will communicate the resolution on that issue when the international Union instructs us to do so. Jan. 10, 2006 I retired in Oct. 06 and was paid unused vacation time for 06. Would I still receive 200 hrs. vacation credit in Jan. 07? The amount of full vacation entitlement for an active employee is based on the employee's seniority on December 31 of that year and the assumption that the employee will work at least 26 pay periods during the year, otherwise it is prorated. Paragraph 195 of the national Agreement provides details for payment of unused vacation time for retirees for the year in which they retire. For the year(s) following your retirement year you will have 52 weeks of paid vacation time and have already worked enough weeks for full entitlement. This is called a retirement pension.
